Penalties Increased. Effective Jan. 15 the Federal Maritime Commission is increasing for inflation the maximum civil monetary penalty amounts for the following regulatory or statutory violations.
- adverse impact on U.S. carriers by foreign shipping practices: from $2,140,973 to $2,166,279
- violation of 1984 Shipping Act or FMC regulation or order issued thereunder: from $61,098 to $61,820 for knowing and willful violations and from $12,219 to $12,363 for others
- operating in foreign commerce after tariff suspension: from $122,197 to $123,641
- failure to provide required reports: from $9,639 to $9,753
- adverse shipping conditions: from $1,927,676 to $1,950,461
- operating after tariff or service contract suspension: from $96,384 to $97,523
- failure to establish financial responsibility for non-performance of transportation or death or injury: from $24,346 to $24,634
- making false claims or giving false statements in violation of Program Fraud Civil Remedies Act: from $11,665 to $11,803
OTI Licenses. The FMC has given notice that the following ocean transportation intermediary licenses have been revoked. A revocation may occur after a license is surrered voluntarily by the OTI or for failure to maintain a valid bond.
